1. About us and these terms

www.seaofseats.com ("Sea of Seats", the "Website") is a product of Booking Studio Private Limited, a company incorporated in India with its registered office at 125, Jeevan Jyoti Enclave, Gautam Budh Nagar, Shaberi, Greater Noida, District Gautambuddha Nagar, Uttar Pradesh - 201009 ("Company", "we", "us" or "our").

These Terms & Conditions ("Terms") apply to your use of the Website and to every enquiry and booking you make with us, whether online, by phone, by WhatsApp or by email. By using the Website or booking with us you accept these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, please do not use the Website.

2. Our role as a travel agent

We act as a booking agent for independent travel service providers such as airlines, hotels, cruise lines, cab and transport operators, tour operators, charter operators and insurance companies (each a "Supplier"). The travel service itself is provided by the Supplier, and your contract for that service is with the Supplier. Each booking is also subject to the Supplier's own terms and conditions, including its fare rules, cancellation rules, baggage rules and check-in policies, which we will share or point you to on request.

Where we sell our own holiday or tour package that combines several services, we will tell you so in the itinerary or quotation, and the specific inclusions, exclusions and cancellation terms in that quotation will apply.

3. Eligibility and your account

• You must be at least 18 years old and able to enter into a binding contract to make a booking.
• If you book for other travellers, you confirm that you have their permission to do so and to share their details with us, and that you will pass these Terms and all booking information on to them.
• You are responsible for keeping your account login details confidential and for all activity under your account.

4. Enquiries, quotes and prices

• Prices shown on the Website, in advertisements or in quotes are indicative until your booking is confirmed. Fares and room rates are set by Suppliers and can change, or sell out, at any time before confirmation.
• Unless stated otherwise, prices are in Indian Rupees (INR). Whether a price includes taxes, port charges, fuel surcharges, service fees or other charges will be shown before you pay.
• "Starting from" and "per adult" prices are for the lowest available category and occupancy, and your final price may differ depending on dates, cabin or room type, and number of travellers.
• If a price is displayed incorrectly because of a technical or typographical error, we may cancel the booking and refund you in full, or offer you the booking at the correct price.
• Submitting an enquiry form does not create a booking. A booking is confirmed only when we have received your payment and sent you a booking confirmation, e-ticket or voucher.

5. Payment

• Payments are processed securely through our payment gateway partner (currently Razorpay) or by bank transfer to Booking Studio Private Limited's account. We never ask for your card PIN, OTP or UPI PIN, and we will never ask you to pay into a personal bank account.
• Some bookings, such as cruises and packages, may require a deposit with the balance due by a stated date. If the balance is not paid on time, the Supplier may cancel the booking and cancellation charges may apply.
• Applicable taxes, including GST and Tax Collected at Source (TCS) on overseas tour packages, will be charged as required by law.

6. Changes and cancellations

• Changes and cancellations requested by you are subject to the Supplier's rules and charges, plus any service fee shown at the time of booking. Some fares and rates are non-refundable or non-changeable.
• If a Supplier cancels or changes a service, we will tell you as soon as we are informed and help you with the alternatives or refund the Supplier offers.
• Refunds are paid to the original payment method after we receive them from the Supplier. Full details are in our Refund & Cancellation Policy.

7. Your responsibilities as a traveller

• Names and details must match your passport or government photo ID exactly. Charges caused by incorrect details are your responsibility.
• You are responsible for holding a valid passport, visas, permits, health certificates and vaccinations needed for your trip. We can share general guidance, but entry decisions are made by the relevant authorities.
• Please arrive in good time for check-in, boarding and embarkation, and reconfirm timings before you travel. Missed departures caused by late arrival are not refundable by us.
• You must follow the rules of the Supplier, including airline, hotel and cruise-ship rules on conduct, safety, baggage and prohibited items.

8. Travel insurance

Travel insurance offered through Sea of Seats is issued by the relevant insurance company, and the policy terms, exclusions and claim decisions are those of the insurer. Please read the policy wording before buying. We strongly recommend travel insurance for every trip, particularly international travel and cruises.

9. Limitation of liability

• As a booking agent, we are not responsible for the acts, omissions, delays, cancellations, overbooking, quality of service, injury, loss or damage caused by a Supplier or by events outside our reasonable control, such as bad weather, natural disasters, strikes, pandemics, war, government action or technical failures of Supplier systems.
• We are responsible for arranging your booking with reasonable care and skill. To the extent permitted by law, our total liability for any claim relating to a booking is limited to the service fee we charged for that booking, or, for a package we sell as principal, the amount you paid us for that package.
• Nothing in these Terms limits any right you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded.

10. Use of the Website

• You may use the Website only for lawful personal travel enquiries and bookings. You must not make speculative, false or fraudulent bookings, or scrape, copy, disrupt or attempt to gain unauthorised access to the Website.
• Content on the Website, including text, design, logos and images, belongs to Booking Studio Private Limited or its licensors. Supplier names, logos and images belong to their respective owners and are used only to describe their services.
• Destination, ship, hotel and itinerary information is provided for guidance and is based on information from Suppliers, which may change.
• Links to third-party websites are provided for convenience; we are not responsible for their content.

11. Communications

By submitting an enquiry or booking, you agree that we may contact you by phone, SMS, email or WhatsApp about your enquiry or booking. Promotional messages are sent only with your consent, and you can opt out at any time. See our Privacy Policy for details.

12. Governing law and disputes

These Terms are governed by the laws of India. We will always try to resolve any complaint with you directly first. Subject to your rights under consumer protection law, the courts at Gautam Buddha Nagar, Uttar Pradesh shall have jurisdiction over any dispute arising from these Terms or a booking.

13. Changes to these Terms

We may update these Terms from time to time. The version in force when you make a booking applies to that booking.
